Terms of Service.

Last updated October 15, 2026.

1. What Kimcee is.

Kimcee is a software platform that lets you build, publish, and sell your own training or content app. We provide the infrastructure. You provide the content, the expertise, and the relationship with your customers.

By creating an account, you agree to these Terms of Service and the Privacy Policy. If you don't agree, don't use the service.

2. You own your content.

Everything you create on Kimcee — your courses, lessons, checklists, trackers, daily content, resources, landing pages, branding, and customer data — is yours. We don't claim ownership of it. We store and serve it on your behalf so that you can run your business.

You grant us a limited license to host, display, back up, and deliver that content to your end-users strictly so the service can function. That license ends when you delete the content or close your account.

3. You are responsible for your content and your customers.

You — not Kimcee — are responsible for the content you publish and for the relationship you have with the people who use your app. That includes:

  • The accuracy, safety, and legality of anything you teach, advise, or recommend.
  • Any outcomes your customers experience from following your content.
  • Billing disputes, refunds, support, and communication with your customers.
  • Compliance with applicable laws — including consumer protection, advertising, professional licensing (fitness, nutrition, medical, legal, financial, etc.), tax obligations, and data protection.

We are a tool. We are not a publisher, a coach, a trainer, a medical provider, a financial advisor, or a guarantor of your results or your customers' results.

4. Acceptable content — what you may not publish.

All content on Kimcee must be legal under United States federal law and appropriate for a general audience. You may not create, upload, or distribute content that:

  • Teaches or facilitates illegal activity of any kind — including instructions on how to harm or kill a person, hire or become a hitman, assemble weapons or explosives, manufacture illegal drugs, commit fraud, hack, or evade law enforcement.
  • Is sexually explicit, pornographic, or otherwise not safe for a family audience.
  • Sexualizes, endangers, or exploits minors in any way.
  • Promotes violence, terrorism, self-harm, suicide, eating disorders, or hate against a protected group.
  • Infringes someone else's copyright, trademark, patent, trade secret, or other intellectual-property or publicity right.
  • Is defamatory, harassing, threatening, or doxxes another person.
  • Contains malware, spyware, phishing attempts, or code intended to disrupt or gain unauthorized access to any system.
  • Violates any U.S. federal, state, or local law, or sanctions or export-control rules.

We may review reported content, suspend or terminate any account that violates these rules, and cooperate with law-enforcement requests. We don't pre-review every piece of content, but we reserve the right to remove anything that breaks these terms.

5. Your account.

You must be at least 18 years old, or the age of majority where you live, to create an account. You're responsible for keeping your login credentials secret and for everything that happens under your account. Tell us right away if you suspect unauthorized access.

6. Payments, subscriptions, and refunds.

Paid plans and token packs are billed through Stripe. By subscribing, you authorize recurring charges until you cancel. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period. Token-pack purchases are one-time and non-refundable once the tokens are credited to your wallet, except where required by law.

Payments from your customers to you are handled through your own connected Stripe account. Those payments are between you and them — we are not a party to them.

7. Service, uptime, and changes.

We work hard to keep Kimcee available, but we don't promise uninterrupted or error-free service. We may update, modify, or discontinue features at any time. We'll give reasonable notice before any change that materially reduces a paid feature you rely on.

8. Suspension and termination.

We may suspend or terminate your account if you break these terms, fail to pay, or use the service in a way that puts us, other users, or the public at risk. You can close your account at any time. On termination, your content may be deleted after a reasonable grace period — export anything you want to keep beforehand.

9. Disclaimer of warranties.

The service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent allowed by law, we disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

10. Limitation of liability.

To the fullest extent allowed by law, Kimcee and its operators are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or business interruption, arising out of or relating to your use of the service — even if we've been warned such damages were possible.

Our total aggregate liability for any claim relating to the service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) one hundred U.S. dollars ($100).

11. Indemnification.

You agree to defend, indemnify, and hold harmless Kimcee and its operators from any claim, damage, loss, liability, cost, or expense (including reasonable attorneys' fees) arising out of or related to (a) your content, (b) your use of the service, (c) your violation of these terms, or (d) your violation of any right of another person.

12. Governing law and disputes.

These terms are governed by the laws of the United States and the state in which we operate, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located there, and you consent to that jurisdiction.

13. Changes to these terms.

We may update these terms from time to time. If we make a material change, we'll notify you by email or in the app. Your continued use of Kimcee after a change means you accept the updated terms.

14. Contact.
